If i decide to open a shop and the fixtures and fittings are lower than the specification agreed what would b?

i proceed againts the people that have put the fixture and fittings in, would they be sussesful or not. what would be the relevant legislation, courts and cases

  1. You need to supervise the process. If they do it wrong work with them to have it corrected. If all else fails then consider legal action.
  2. If the specification was in writing and part of the contract you can file for breach of contract. There are two ways to remedy the damages. 1. Sue for either the replacement of the fixtures to the specified grade. 2. Sue for reimbursement of the difference in price between the sub-par items and that which was in the contract.
  3. If you haven't completed the transaction, your appraiser can leave the report incomplete as per the "plans and specs" portion of the report at the bottom of page two of the form. If it is a commercial appraisal he will have a similar format in the Word document he submits. It might cost you an extra hundred bucks for a final inspection but it will be much cheaper than litigation. You might have to bring this to his attention. If you have completed the transaction, you may just have to live with it. It's too costly to sue and you probably won't win with the number of professionals involved in completing the construction who have signed off on it as being "satisfactorily completed". The most important signature being yours.
